1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Laukahi (Narahiya O.P.) P.S. Case No. 35 of 2023 (G.R. No. 249 of 2023) dated 10.02.2023 registered for the offences punishable under Sections 25(1-b)a/26 of the Arms Act.
3. The main submissions advanced by the learned counsel for the petitioner are that as per the allegation only one country made pistol with a live cartridge is stated to have been recovered from the possession of this petitioner but the said allegation is completely false and petitioner belongs to a poor family and has been languishing in jail since 11.02.2023 and he has has been falsely implicated in this case due to village politics in collusion with the police and against him the
Patna High Court CR. MISC. No.43633 of 2023(2) dt.24-07-2023 2/2 investigation has been completed and he has fair and clean antecedent.
4. Learned APP appearing for the State opposes the bail prayer.
5. Having regard to the facts and circumstances of this case and considering the above submissions and mainly the petitioner's fair antecedent and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Laukahi (Narahiya O.P.) P.S. Case No. 35 of 2023 (G.R. No. 249 of 2023) on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) Rajiv/- U T
