The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147/148/149/341/324/308/325/506 of the Indian Penal Code. According to FIR, ten persons allegedly assaulted to the informant for the reason that informant was a witness in a land dispute case. The doctor has found one fracture at the wrist and fracture at the 6th rib of the chest.
Patna High Court Cr.Misc. No.59381 of 2018(2) dt.02-11-2018 2/3 Submission is that the informant might have sustained injury by fall at the time of his criminal activity in counter case. The material is not sufficient against anyone. Petitioners have got no criminal antecedent.
Considering the entire facts and circumstances of this case and general and omnibus nature of allegation, let the petitioners, above named, except Baijnath Yadav @ Mausam Vibhag @ Baidyanath Yadav for the reason that Baijnath Yadav is accused in connection with Bangaon P.S. 68 of 2007 and has suppressed the aforesaid fact in para-3 of the bail petition, Baijnath Yadav @ Mausam Vibhag @ Baidyanath Yadav is directed to surrender within four weeks and prayer for regular bail, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bangaon Police Station Case No.59 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court
Patna High Court Cr.Misc. No.59381 of 2018(2) dt.02-11-2018 3/3 below shall be at liberty to cancel the bail bond of the petitioners.
