The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354A, 504, 506/34 of the Indian Penal Code.
The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that the accused persons including the petitioners came to his house and started assaulting the informant and his family members and it is alleged that these petitioners along with Mahesh Mahto and Lal Babu Mahto
Patna High Court CR. MISC. No.52473 of 2021(3) dt.30-06-2022 2/2 assaulted Ravi Chandan Kumar, nephew of the informant by iron rod causing injury on his head.
The learned counsel for the petitioners submits that the allegation of assault is general and omnibus in nature and the injury of Ravi Chandan Kumar is simple in nature as would be evident from Annexure-2 series to the anticipatory bail application and the blow is not repeated.
Learned A.P.P. opposes the bail application.
Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Dumra P. S. Case No.174 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
