This is an application for bail in connection with Jagdishpur P.S. Case No. 110 of 2017, registered for the offences punishable under Sections 302 of the Indian Penal Code and Section 27 of the Arms Act (G.R. No. 1724 of 2017). Allegation as per F.I.R. is of firing on the deceased. Submission of learned counsel for the petitioner is that the petitioner is not named in F.I.R. Later on, his name transpired during course of investigation. He has been falsely implicated in this case. There is absolutely no direct material to connect him with the alleged offence of murder of the deceased. The petitioner is in custody since 20.05.2017. Heard learned APP as well as the learned counsel for
Patna High Court Cr.Misc. No.49891 of 2017 (3) dt.14-11-2017 2/3 the informant opposed the prayer of bail.
Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of ACJM-XI, Ara Bhojpur, in connection with Jagdishpur Case No. 110 of 2017, subject to the conditions as follows:
(1) One of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of the court concerned.
(2) Petitioner will mark his attendance in local station in first week of every month at least for one year so that police may watch his conduct during the said period, failing which his bail bond shall be cancelled.
(3) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure
Patna High Court Cr.Misc. No.49891 of 2017 (3) dt.14-11-2017 3/3 on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of his bail bonds.
However, the learned trial court is directed to expedite the trial at the earliest.
