JUSTICE SANJAY KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with Kurtha Police Station Case No. 167 of 2016 registered for offence punishable under section 392 of the Indian Penal Code. It has been submitted that the case was registered under section 392 of the Indian Penal Code against two FIR named and four unknown persons. The petitioner is neither named in the FIR nor any incriminating material has been recovered from his possession. He has not been put on T.I.P.. The name of this petitioner has surfaced in confessional statement of co-accused, Ranjit Kumar, who disclosed the name of two others also. Out of them Deepak Sao @ Deepak Saw and Amit Kumar @ Daru, whose names surfaced in confessional statement of Ranjit Kumar, have been allowed bail by the different coordinate Benches of this

Patna High Court Cr.Misc. No.46878 of 2017 (2) dt.21-09-2017 2/2 Court in Criminal Misc. Nos. 41834 and 38095 of 2017 on 11.09.2017 and 10.08.2017. The case of the petitioner stands on similar footing. He is in custody since 10.07.2017 and so he also deserves to be enlarged on bail.

The learned Additional Public Prosecutor on the other hand opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed and the petitioner- Ravi Kumar is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Kurtha Police Station Case No. 167 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
