ANJANA MISHRA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Sirdalla P.S. Case No.164 of 2014 registered under section 302/34 of the Indian Penal Code.

Earlier the case diary was called for which has been received.

Learned counsel for the petitioner submits that the petitioner was neither named in the FIR nor there is any incriminating material against him. It is submitted that subsequently in the re-statement of the informant, the name of the petitioner surfaced on suspicion. He further submits that other similarly situated persons have been extended privilege of

Patna High Court Cr.Misc. No.32653 of 2015 (3) dt.16-10-2015 2/2 anticipatory bail vide order dated 29.1.2015 passed in Cr. Misc. No.3731 of 2015.

Considering the aforementioned facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond Rs.10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Sirdalla P.S. Case No.164 of 2014, subject to the conditions as laid down under section 438

(2) of the Code of Criminal Procedure.
