The petitioner apprehends his arrest in connection with Sahebganj P.S. Case no. 176 of 2016, registered under Section 420 and 409 of the Indian Penal Code.
The accusation is that in spite of direction to the Panchayat Secretaries and Executive Officer, Nagar Panchayat Sahebganj, they did not deposit the merit list and folder regarding appointment of primary teacher. The petitioner was also Panchayat Secretary of Pakari Basarat.
Learned counsel for the petitioner submits that petitioner took the charge of Panchayat Secretary on 07.01.2015 to the Chandra Shekhar Prasad Singh, Ex-Secretary, who only handed over the register of 2008 regarding appointment of the Panchayat Teacher, which would appear from Annexure-02 and on receiving the direction,
Patna High Court Cr.Misc. No.55716 of 2016 (2) dt.12-01-2017 2/2 petitioner deposited the same on 05.06.2015 at Sahebganj Block with only merit list and folder of the appointment of the Panchayat Teacher in year 2008, which was received by him to the Ex-Secretary as such petitioner has not disobeyed the direction of the authorities. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, West Muzaffarpur in connection with Sahebganj P.S. Case No.176 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
