The petitioner who is the husband of the deceased who is in custody since 21.03.2023 in connection with Brahampur P.S. Case No. 488/2022 registered for the offence punishable under Sections 498(A)/304(B)/120(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that false and fabricated allegations have been levelled against the petitioner. It is further submitted that the deceased died due to negligence in treatment and wrong decision taken by the
Patna High Court CR. MISC. No.45996 of 2023(2) dt.04-08-2023 2/2 informant party. Petitioner has no criminal antecedent. However, learned counsel appearing on behalf of the informant vehemently opposed the bail application. In view of the aforementioned facts and circumstances and the fact that the deceased was treated with several medical facilities including Ruban hospital at Patna, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahampur P.S. Case No. 488/2022.
