JUSTICE BIRENDRA KUMAR ORAL ORDER 17-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Ara Town P.S.Case No.394/16 for the offence under Section 302/34 of the I.P.C.
The prosecution case, in brief, is that the daughter Rita Devi, of the informant was married with the petitioner in the year 2007. Further allegation is that she was done to death due to torture and assault.
Submission of the petitioner is that there is ample documentary evidence to substantiate the fact that the victim died due to prolonged illness.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Ara,Bhojpur, in Ara Town P.S.
