The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, the nine named accused persons including the petitioner herein are stated to have come variously armed. It is further stated that the petitioner assaulted Bhantu Ram and Anandi Ram with a farsa leading to injuries. It is submitted by learned counsel for the petitioner that the parties are agnates and the petitioner has been falsely implicated in the case for oblique reasons. Accepting the allegations for the sake of argument, it is submitted that from perusal of the injury reports brought on record, the injury on

Patna High Court CR. MISC. No.52546 of 2021(2) dt.09-03-2022 2/2 Anandi Ram is simple while the injury on Bhantu Ram although the same has been opined to be grievous in nature, however it is allegedly caused on ulna. The petitioner is in custody since 27.5.2021 and has no criminal antecedent.

The application for bail is opposed by learned A.P.P. for the State and learned counsel for the informant. It is submitted by learned counsel for the informant that there is direct allegation against this petitioner of having assaulted with a farsa causing injury on Bhantu Ram which has been found to be grievous in nature.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 9 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Sahebganj P.S. Case no.178 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Muzaffarpur.
