Petitioner apprehends his arrest in connection with Kanti (Panapur O.P.) P.S. Case No. 108 of 2016 registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act. It is submitted that the name of the petitioner has been taken by co-accused who was apprehended with loaded country made pistol. The petitioner has not been apprehended at the spot, besides the confessional statement there is nothing against him. The petitioner has got clean antecedent. The name of the petitioner has been taken by co-accused due to political rivalry and village politics and as such the petitioner deserves sympathetic consideration to which the learned APP opposes.
Patna High Court Cr.Misc. No.53738 of 2016 (2) dt.20-12-2016 In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Kanti (Panapur O.P.) P.S. Case No. 108 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
