The Petitioner seeks bail in Choutarawa (Bathawariya) P.S. Case No. 15 of 2005 registered for the offence punishable under Sections 147, 148, 149, 353 and 307, of the Indian Penal Code and 25(1-B)a, 26, 27 and 35 of the Arms Act.
A report has been received by the trial court kept at 'Flag-X' in which it has been stated that the trial of the petitioner shall be concluded within a period of six months. In view of the above, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.
However, it is observed that if the trial of the
Patna High Court Cr.Misc. No.60824 of 2018(4) dt.20-11-2018 2/2 petitioner is not concluded within a period of six months, petitioner would be at liberty to renew his prayer for bail. Subject to the aforesaid observation, this application is disposed of.
