1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Barauni Refinery P.S. Case No. 243 of 2023 dated 15.05.2023 registered for the offences punishable under Sections 465, 467, 468, 471, 419 and 420 of the Indian Penal Code.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is a student and has been languishing in jail since 16.05.2023 having fair and clean antecedent and as per allegation other person appeared in written examination on behalf of the petitioner and because of the biometric identification of this petitioner and his photo having not been matched, the allegation of impersonation was levelled against him but the alleged offences of Sections 465,

Patna High Court CR. MISC. No.43642 of 2023(2) dt.25-07-2023 2/2 467, 468 and 471 of the IPC are not made out in this case and the maximum punishment for the offence of section 419 of the IPC is imprisonment of three years and against the petitioner the investigation has been completed.

4. Learned APP appearing for the State opposes the bail prayer.

5. Having regard to the facts and circumstances of this case and mainly petitioner's young age and fair and clean antecedent, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Barauni Refinery P.S. Case No. 243 of 2023 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
