====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 03-07-2025 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the BPSC.

2. The present writ petition has been filed with the following relief(s):

"(i) For direction/order to the respondent no. 4 Chairman and Respondent No.-6 Examination controller BPSC to publish the result of the petitioner bearing his Roll No. 126333 obtained the total marks 283 under Schedule Caste, only three (3)

Patna High Court CWJC No.10194 of 2025(2) dt.03-07-2025 2/3 marks less than the cut off marks 286 of the result published concerning advertisement No. 18, 19, 20, 21/2024 and on the same cutoff marks other candidate was selected but in spite of vacant seat, the petitioner was not called for his selection.

(ii) For selection of petitioner is existing vacant seat under aforesaid advertisement.

(iii) Other remedy/remedies as your lordships may be pleased to deem fit and proper in the interest of justice to the petitioner."

Learned counsel appearing for the BPSC submits that the petitioner has filed representation before the Examination Controller, Bihar Public Service Commission, but no decision has been taken till date. Counsel further submits that a time may be fixed so that the decision may be taken with regard to petitioner's representation.

4. In the light of the submissions made, the petitioner is hereby directed to file representation before the Respondent

Patna High Court CWJC No.10194 of 2025(2) dt.03-07-2025 3/3 No.5, Secretary, Bihar Public Service Commission, Patna within 30 days from today along with the copy of this order and the Examination Controller, Bihar Public Service Commission shall take decision with regard to petitioner's representation within 90 days from the date of receiving of the said representation.
