The petitioners are apprehending their arrest in connection with SC/ST P.S. Case No.04 of 2014 for the offences instituted under Sections 341, 323, 427, 385 and 504/34 of the Indian Penal Code and section 3(i)(x) SC/ST Act. The prosecution story, in brief, is that on 4.11.2013 at 7.00 a.m. the informant was at his door, all the accused persons armed with weapon came and abused the complainant by using 'Shala Harizan Chamar' and protested for construction of house in their land and told that said land has been purchased, but the

No.49879 of 2015 (2) dt.09-02-2016 2/3 complainant told that said land has been purchased by me told to Angad Kumar Singh and Ashutosh Singh, but all the accused persons broken construction of the complainant and gave threatening to vacate the land and demanding Rs.2 lac rangdari. So, it appears that it is alleged that the accused gave threatening to the complainant with castist angle.
It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. There is admittedly land dispute between the parties. It is a case and counter. Counter case (Annexure-2) was instituted prior to the institution of the present case. Police after investigating the present case has submitted a final form.
On behalf of the State, it is submitted that the petitioner are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with SC/ST P.S. Case No.04 of 2014, subject to the conditions as laid down under Section 438(2) of the
Patna High Court Cr.Misc. No.49879 of 2015 (2) dt.09-02-2016 3/3 Code of Criminal Procedure.
