The petitioner has preferred this application for grant of regular bail in a case registered under sections 414 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, a total of 664.125 litres of liquor was recovered from the Scorpio vehicle which was being driven by this petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He has no concern with the seized vehicle nor with the seized liquor. The petitioner is in custody since 24.7.2021 and has no antecedent under the Bihar Prohibition and Excise Act, 2016.

No.52551 of 2021(2) dt.07-10-2021 2/2 It is further submitted by learned counsel for the petitioner that the cause of urgent hearing of the instant case is the serious medical condition of the new born baby of the petitioner who has been referred for higher paediatric procedure relating to cardiology either in the SGPGIMS, Lucknow or AIIMS, New Delhi.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent under the Bihar Prohibition and Excise Act, 2016, the petitioner is directed to be enlarged on bail in connection with Raghopur (Rustampur) P.S. Case no. 162 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II-cum-Special Judge, Excise Court, Vaishali at Hajipur. (Partha Sarthy, J) Spd/- U T
