JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in connection with Bounsi P.S. Case No. 107 of 2015 registered under Sections341, 323, 379, 384, 504, 506/34 of the Indian Penal Code. It is alleged by that informant that when he was unloading potato, one person came and demanded Rangdari. On protest, accused started assaulting. Villagers came and accused escaped. Villagers disclosed the name of the accused as Bijay Baitha i.e. the present petitioner.

Learned counsel for the petitioner submits that petitioner is innocent and has been implicated in the case due to village politics. It is further submitted that allegations levelled

Patna High Court Cr.Misc. No.43502 of 2016 (4) dt.08-02-2017 does not come under purview of section 384 and 379 I.P.C. Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Araria in connection with Bousi P.S. Case No. 107 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
