The petitioner prays for anticipatory bail in connection with Sahebganj P.S. case no. 331 of 2014 registered for the offences punishable under Sections 341, 323, 324, 325, 307, 447, 504/34 of the Indian Penal Code.

It has been submitted on behalf of petitioner that though in the F.I.R., there is allegation that petitioner assaulted son of the informant and blood oozed out but no weapon as alleged by which he has been assaulted, is used. It is further submitted that there is case and counter case, pending between the parties due to land dispute as is evident from the impugned order. Heard learned A.P.P.

Having heard both sides and considering the fact

Patna High Court Cr.Misc. No.48252 of 2016 (2) dt.16-12-2016 2/2 that no specific weapon as alleged has been used by the accused, and there is case and counter case, pending between the parties and the injury found is not serious, let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate (West), Muzaffarpur in connection with Sahebganj P.S. case no. 331 of 2014 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
