The petitioner seeks bail in POCSO Case No. 11/2019, arising out of Supaul Mahila P.S. Case NO. 12/2019, instituted for offence under Section(s) 341 and 376 of the Indian Penal Code read with Sections 4 and 6 of POCSO Act. It is alleged in the written report that petitioner committed rape with 11 year old daughter of informant. Report from the court below regarding present stage of case has been received, wherein it is mentioned that out of 8 witnesses, 7 witnesses have already been examined. Doctor is yet to be examined. It is mentioned in the report that trial is likely to be concluded within one month.

This Court finds that trial has progressed sufficiently.

Patna High Court CR. MISC. No.39916 of 2019(4) dt.28-08-2019 2/2 Therefore, this Court is not inclined to grant bail to petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected.

The trial court is directed to expedite the trial and made efforts to conclude the same within a period of three months from the date of receipt/production of copy of this order and send compliance report.
