JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Saraiya P.S. Case No. 52 of 2017 dated 16.2.2017 for the offences punishable under Sections 25(1-B)A/26/35 of Arms Act. The case of the prosecution is that the police upon receiving secret information that certain accused persons had gathered for committing dacoity, raided the place of occurrence and apprehended 8 persons along with the petitioner. As far as the petitioner is concerned, one country made pistol and some live cartridges were recovered.

The learned counsel for the petitioner submits that the petitioner is on bail in only case pending against him and he is in custody since 16.02.2017 and he has already suitably been

Patna High Court Cr.Misc. No.50040 of 2017 (2) dt.17-10-2017 2/2 incarcerated.

In the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bonds of Rs. 50,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Magistrate, West, Muzaffarpur in connection with Saraiya P.S. Case No. 52 of 2017 dated 16.2.2017.
