The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 06 of 2021 registered for the offence under Sections 354 (C), 34, 376, 493, 313 of the Indian Penal Code and Section 67(A) of the Information Technology Act. Learned counsel for the petitioner submits that allegation against the petitioner is that the petitioner and the informant was in living relationship and with promise of marriage with consent established physical relationship with the informant and her child was forcibly aborted by the petitioner and his parents.
Learned counsel for the petitioner further submits that the parents have already been granted anticipatory bail by this
Patna High Court CR. MISC. No.52797 of 2021(2) dt.17-02-2022 2/2 Court.
Taking into consideration aforesaid facts, prima facie case under Section 376 of the I.P.C. is not made out against the petitioner, I am inclined to grant benefit of anticipatory bail to the above named petitioner and in the event of arrest he shall be released on bail, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
