JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Forest Case No. 21 of 2005, T.R. No. 1074 of 2016, for the offences instituted under Sections 33, 41, 42, 29 and 51 of the Forest Act.
It is alleged that some miscreants had collected some cutting trees and when they saw the patrolling party, they fled away. Thereafter the informant seized the collected fuel wood and accordingly, seizure list was prepared.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the
Patna High Court Cr.Misc. No.42394 of 2016 (4) dt.15-12-2016 2/2 petitioners. The petitioners have been made accused due to mistake of fact. No forest produce has been recovered from the possessions of the petitioners.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, the provisional bail granted to the petitioners vide order date 18.10.2016, is hereby, confirmed.
