The petitioner, who is in custody, seeks bail in connection with Baikunthpur P.S. Case No. 20 of 2018 registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), (b), (C) of the Bihar Prohibition and Excise Act, 2016.
Allegation against petitioner is of recovery of 2090.880 litres of foreign liquor from the tanker. It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case merely on suspicion. Name of petitioner has surfaced on confessional statement of cleaner (Khalasi) of the vehicle who was apprehended at the spot has been granted bail by this
Patna High Court Cr.Misc. No.58664 of 2018(4) dt.10-10-2018 2/2 Hon'ble Court as contained in Annexure-2. Petitioner has not been apprehended at the spot and nothing has been recovered from his possession. Petitioner has no criminal antecedent and he is in custody since 03.08.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned IInd Additional Sessions Judge cum Special Judge, Gopalganj, in connection with Baikunthpur P.S.
