ANJANA MISHRA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 406/420 and 120-B of the Indian Penal Code.

Learned counsel for the petitioner submits that admittedly whatever money was deposited, was not with the present petitioner. Rather, it was deposited in the account of the company. Thus, any misappropriation/defalcation/embezzlement of money for non-supply of correct and required tractors was at the hands of the company and not the present petitioner.

In view of the aforementioned facts and circumstances, let

Patna High Court Cr.Misc. No.36824 of 2016 (3) dt.03-10-2016 P2/2 the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Complaint Case No. 46/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
