The petitioners seek bail in anticipation of their arrest in connection with Narhat P.S. Case No. 157 of 2020 instituted for the offences under Sections 323, 325, 307, 385, 379, 504 and 506 of the Indian Penal Code. The petitioner no. 1 is said to have assaulted one Deepak who has received simple injuries. Petitioner no. 2 is said to have assaulted one Amresh who has received three injuries out of which two have been opined to be

Learned counsel for the petitioner has submitted that there is counter version of the occurrence as well and five persons have been injured in such occurrence. However, there is no mention of the aforesaid fact in the subject F.I.R. which according to learned counsel for the petitioners is a serious omission on the part of the informant. There is a dispute with respect to construction of a house on a land over which both the parties have staked their claim.
Considering the afore-stated facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the Court below within a period of eight weeks from the date of receipt/ production of a copy of this order, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Nawada, in connection with Narhat P.S. Case No. 157 of 2020, subject to the condition laid down under Section 438(2) of the Code of Criminal
