The petitioner has renewed his prayer for Anticipatory bail in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The basic accusation is of torture for nonfulfilment of dowry demand. The petitioner earlier preferred Cr. Misc. No. 11391 of 2016 which was disposed of vide order dated 09.03.2016 since petitioner failed to appear in spite of matter being adjourned on several occasions.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.47198 of 2016 (2) dt.12-04-2017 2/2 petitioner that petitioner denies the factum of marriage. Considering the fact that earlier bail application of the petitioner was disposed of due to non-appearance of the petitioner in spite of being given several opportunities, this Court is not inclined to revise the order. However, the petitioner may surrender before learned Court below and pray for bail within a period of six weeks, which shall be considered by learned Court below without being prejudiced by the order of this Court. Accordingly the application is disposed of in connection with Bidupur P.S. Case No. 203 of 2015, pending in the Court of learned Chief Judicial Magistrate, Vaishali at Hajipur.
