Petitioners seek regular bail in connection with Sasaram Town PS Case No. 213/2021 registered for the offences
Patna High Court CR. MISC. No.52469 of 2021(2) dt.29-04-2022 2/3 punishable under Sections 399/402 of the Indian Penal Code, Sections 25(1-b)a, 26/35 of the Arms Act.
The police on the basis of secret information raided the house of one Manoj Pandey and recovered 9 mm dummy pistol along with one empty magazine, two live cartridges, Mobile phones from possession of the petitioner Rahul Kumar Singh and from possession of petitioner Sujeet Kumar Verma, one loaded country made Katta, four Mobile phones and a sum of Rs. 30,000/- were recovered.
Learned counsel for the petitioners submits that the petitioners have been implicated in this case by the police with oblique motive and at the time of search and seizure no procedure prescribed under Section 100 Cr. P.C was followed. She further submits that the petitioner is in custody since 23.03.2021 and 21.3.2021 respectivesly and charge-sheet in the matter has already been submitted.
Having regards to the submissions made by the parties and taking into consideration the material on record, the fact that the petitioners are in custody since 23.03.2021 and 21.03.2021 respectively and the charge-sheet has been submitted in the matter, I am inclined to grant regular bail to the petitioners.

No.52469 of 2021(2) dt.29-04-2022 3/3 Accordingly, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram Town P.S. Case No. 213/2021.
