JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 31-07-2019 Vide letter no.76/2019 dated 17.07.2019, the learned lower Court has requested for four months more time to conclude the trial submitting that the prosecution has examined ten witnesses in the case and three witnesses have been given up. Seized articles has not been produced before the Court despite calling for and two I.O. are left to be examined in the case.
Earlier the learned lower Court was given time on two occasions to conclude the trial and lastly vide order dated 20.02.2019, the learned lower Court was granted four months time to conclude the trial fixing the case on day to day basis and the Superintendent of Police, Aurangabad was directed to ensure production of the witnesses in the case one each and
Patna High Court CR. MISC. No.58753 of 2018(6) dt.31-07-2019 2/2 every date fixed without fail but the trial has yet not been concluded.
However, the learned lower Court is directed to conclude the trial within two months positively from the date of receipt/production of a copy of this order fixing the case on day to day basis and the Superintendent of Police, Auranagabad is directed to ensure the production of the seized articles called for and the remaining witnesses on the date fixed in the case without fail else this Court will be constrained to take serious note against him.
