JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner, informant and the learned A.P.P. for the State.

The petitioner seeks bail in Etarhi P.S. Case No. 84/2018, instituted for the offences under Sections 302, 201 and 34 of the Indian Penal Code.

It is alleged in the written report that dead body of Radheshyam Singh, elder brother of informant was recovered from a well situated at South field of Kadipur on 05.04.2018. It is further alleged that the deceased had gone from home but did not return. Informant has raised suspicion against this petitioner and four unknown persons.

Learned counsel for the informant has submitted that during investigation one of the witness who is said to be cousin

Patna High Court Cr.Misc. No.58705 of 2018 (3) dt.06-11-2018 2/2 brother of informant, namely Raju Singh and Sukhram Singh have stated that they had seen the petitioner along with four unknown persons with the deceased.

In this manner, besides suspicion there is no material against this petitioner.

Petitioner is in custody since 02.08.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate IInd, Buxar in connection with Itarhi P.S. Case No. 84/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
