JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 47(a)(f) of the Excise Act and Section 2(E), 2/5(B), 18 of Mahua Flower Act.

The prosecution case is of recovery of five quintals of Mahua flowers from a room adjacent to the joint family house of the petitioner.

It is submitted by learned counsel for the petitioner that recovery was made from the joint family house. The F.I.R was registered on 14.09.2015 which reached to the Court of learned A.C.J.M on 17.09.2015 which clouds the bona fide of the accusation.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner

Patna High Court Cr.Misc. No.51418 of 2015 (2) dt.10-11-2015 2/2 surrenders within a period of six weeks in connection with Anti P.S. Case No. 44 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Gaya.

With the observations above, the application stands disposed off.
