The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 30(c), 30(d) and 41(1) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, a total of 94 litres approx of liquor was recovered from the house/premises of the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article nor any liquor has been recovered as alleged in the F.I.R. He is in custody since 12.7.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for about 8 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Hiramma P.S. Case no.49 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise, Sheohar.
