The petitioner seeks bail in Town (Muzaffarpur) P.S. Case No. 484 of 2020, registered for the offence punishable punishable under Sections 272, 273 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

100 litres of country made Mahua liquor has been recovered from two motorcycles and two persons were apprehended on the spot who disclosed the name of this petitioner as one of their associates.

It is submitted that no recovery has been made from conscious possession of this petitioner and he was not

Patna High Court CR. MISC. No.53124 of 2021(2) dt.01-12-2021 2/2 apprehended on the spot. Petitioner is neither driver nor owner of vehicles in question and he has no concern with the seized liquor. Petitioner is in custody since 09.01.2021. Investigation is complete.

Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur in connection with Town (Muzaffarpur) P.S. Case No. 484 of 2020.
