JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-06-2021 Mr. Bishwa Bijay Kumar, learned counsel for the petitioners seeks permission to withdraw the application with respect to petitioner no. 2, who has been arrested.

The application with respect to petitioner no. 2 is dismissed as having become infructuous.

The petitioner no. 1 seeks bail in anticipation of his arrest in connection with Deep Nagar P. S. Case No. 113 of 2020, dated 01.05.2020, instituted for the offences under Sections 323, 341, 427, 324, 307 and 34 of the Indian Penal Code and 27 of the Arms Act,

Patna High Court CR. MISC. No.294 of 2021(2) dt.23-06-2021 2/2 1959.

Though there is no specific accusation against the petitioner no. 1 of assaulting but considering the background facts of this case, I am not inclined to grant anticipatory bail to him.

The prayer for anticipatory bail is rejected. However, if the petitioner no. 1 surrenders before the court below and seeks bail, that shall be considered on its own merits, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court.
