The petitioner seeks bail in Derni P.S. Case No. 62 of 2021, registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code.

As per the FIR, both minor daughters of the informant are alleged to have kidnapped by the accused persons. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of tower location. The victim girl in her statement under Section 164 Cr.P.C has stated that she has left her house with her younger sister out of her own will and gone to Gangawara and performed marriage with the petitioner on 15.04.2021. She further stated that she is happy at her Sasural

Patna High Court CR. MISC. No.52529 of 2021(3) dt.21-01-2022 2/2 (Gangwara). Petitioner is in custody since 20.04.2021. Investigation is complete.

In view of statement of victim girl under Section 164 Cr.P.C, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Saran, Chapra in connection with Derni P.S.
