The petitioner seeks bail in connection with Special Case No. 53 of 2017, arising out of Shastri Nagar P.S. Case No. 222 of 2017 dated 16.04.2017 instituted for the offences under Sections 20, 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985.
On secret information regarding sale and purchase of narcotics, one Deepak Kumar Sahani was arrested from near Sheikhpura Bind Toli turning and from him Ganja was recovered. On the statement of aforesaid Deepak Kumar Sahani, the house of one Pappu Singh was raided which was taken on rent by the petitioner and one Md. Dablu. From that house, 25 Kgs and 9 grams of Ganja was recovered. The petitioner was found to be

Though co-accused Md. Dablu has been granted bail on the ground that the petitioner was the owner of the house but it has been demonstrated from the investigation papers that the house belongs to one Pappu Singh and the petitioner as well as Md. Dablu were tenants. The petitioner is in custody since 16.04.2017 and does not bear any criminal antecedent. Md. Dablu, one of the co-accused of this case has been granted bail by this Court on 08.12.2017 passed in Cr. Misc. No. 47171 of 2017. Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner also. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, III, Patna in connection with Special Case No. 53 of 2017, arising out of Shastri Nagar P.S. Case No. 222 of 2017.
