This is an application for bail in connection with Patrakar Nagar P.S.Case No. 481 of 2017, arising out of Special Case No. 5971 of 2017, registered for the offences punishable under Sections 30(a), 30(b), 38 and 41 of Bihar Prohibition and Excise Act.

Allegation against the petitioner is of recovery of 601 litres of liquor from the vehicle and petitioner was arrested at the spot. It is said that car belongs to the petitioner. Submission of learned counsel for the petitioner is that car does not belong to the petitioner and as he was standing there he was arrested and he is in custody for two months, having no criminal antecedent.

Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna, in connection with Patrakar Nagar P.S.Case No. 481 of 2017, arising out of Special Case No. 5971 of 2017, subject to the following conditions :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) If involvement of the petitioner is found in future in such type of cases, his bail bond shall be cancelled.
