This application for anticipatory bail arises out of Kutumba P.S. Case No. 133 of 2017, disclosing offences under Sections 147, 149, 341, 323, 427, 353, 379 and 504 of the Indian Penal Code.
The informant is a Doctor working in a referral hospital, Kutumba in the district of Aurangabad. It appears from the FIR that one patient died in the hospital and her attendants blamed the lack of proper treatment and adequate arrangement in the hospital for her death. Allegedly, 250-300 people indulged in vandalism and damaged various articles of the hospital.
Patna High Court CR. MISC. No.40119 of 2019(2) dt.01-07-2019 2/2 Learned counsel for the petitioners has submitted that, in similar circumstance, some other accused persons, named in the FIR, have been allowed anticipatory bail. Considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 133 of 2017, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
