The petitioner seeks bail in connection with Telhara P.S. Case No. 111 of 2017 registered under Sections 379, 411, 188 of the Indian Penal Code and under Section 4/40 of Bihar Mines Mineral Concession Act-1972.

Petitioner is said to have been transporting illegal sand on his tractor.

It is submitted by the learned counsel for the petitioner that the petitioner happens to be mere driver of the tractor. He has no concern with the aforesaid sand. He has no criminal antecedent. The petitioner has been languishing in

Patna High Court Cr.Misc. No.52479 of 2017 (2) dt.12-12-2017 custody since 28.07.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Hilsa (Nalanda) in connection with Telhara P.S. Case No. 111 of 2017.
