The petitioner seeks bail in connection with Mahendiya P.S. Case No. 51/2016 dated 01.06.2016 instituted for the offences under Sections 304(B), 201 and 34 of the Indian Penal Code. The petitioner is the younger brother of the husband of the deceased. It has been alleged in the F.I.R. that the deceased Ranju Devi was married to one Raktu Rajbanshi about seven years ago. With respect to her death, information was provided to the informant on telephone by the husband of the deceased. Later, the present case was lodged.
Learned counsel for the petitioner has submitted that the mother-in-law and another brother-in-law of the deceased have been granted anticipatory bail by a co-ordinate Bench of this
Patna High Court Cr.Misc. No.53494 of 2017 (3) dt.08-12-2017 2/2 Court. It has further been submitted that the husband of the deceased is in jail.
Regard being had to the fact that there is no specific allegation against the petitioner and that similarly situated other co-accused persons have been granted bail, this Court is inclined to grant bail to the petitioner as well, who is said to be in custody since 31.07.2017.
The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Mahendiya P.S. Case No. 51/2016.
