Petitioner seeks bail in Paras Bigha P.S. Case No.129 of 2016 instituted for the offence under Section(s) 304B, 201, 120-B Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Jehanabad.

Counsel for the petitioner submits that petitioner is husband of the deceased.

It is alleged that petitioner has committed murder of the deceased for non-fulfillment of demand of dowry and disposed off the dead body.

Learned APP has submitted that in the case diary it has come that postmortem of the dead body could not be performed because accused persons had disposed off the dead

Counsel for the petitioner submits that Compromise Petition has been filed by the Informant.

The offence under Section(s) 304-B Indian Penal Code is non-compoundable. It is only an attempt to tamper with the evidence in the case.

In such circumstances, this Court is not inclined to enlarge the petitioner on bail.

Prayer of the petitioner for grant of bail is rejected. The Trial Court is directed to expedite the trial and conclude the same as early as possible, preferably, within a period of nine months from the date of receipt of copy of this order.
