The petitioners seek bail in a case registered for the offence punishable under Sections 341, 323, 504, 307, 34 of the Indian Penal Code.

Prosecution case in brief is that on 19.02.2020 the informant was going to his field, the accused persons named in the FIR, came with lathi, danda etc. and abused and assaulted the informant in which he got injuries over his head. When his wife came to rescue him, she was also assaulted. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this

Patna High Court CR. MISC. No.40063 of 2020(3) dt.24-03-2021 2/2 case. He further submits that there is general and omnibus allegation against the petitioners. There is case and counter case between the parties and both are Gotias. The petitioners are languishing in judicial custody since 31.08.2020. The petitioners have got no criminal antecedent which is mentioned in para 3 of the bail petition.

Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each in connection with Rajpur P.S. Case No. 35/2020 to the satisfaction of learned Court below where the case is pending. (Anjani Kumar Sharan, J) amitkumar/- U T
