The petitioner apprehends his arrest in connection with Dinara P.S. Case No. 50 of 2017 instituted for the offences punishable under Sections 20, 21 and 23 of the N.D.P.S. Act. It has been submitted that the apprehended accused Rajnish Upadhyay @ Sonu Pandey has been granted bail by the learned court below. The other co-accused Pankaj Kumar Singh Badal @ Badal Singh has also been granted anticipatory bail by one of the co-ordinate Bench of this Court on 12.07.2017 in Criminal Miscellaneous No. 29918 of 2017. The case of this petitioner stands on similar footing and so, he deserves anticipatory bail.

Patna High Court Cr.Misc. No.50360 of 2017 (2) dt.31-10-2017 The learned A.P.P. for the State, on the other hand, opposed the submission.

Considering the facts and circumstances of the case and also the fact that the case of this petitioner stands on similar footing, the anticipatory bail prayer is allowed. The petitioner, above named, in the event of arrest / surrender within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Rohtas at Sasaram in connection with Dinara P.S. Case No. 50 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
