Mr.Umeshanand Pandit ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-07-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioner apprehend their arrest in connection with Mejorganj P.S. Case no. 423 of 2018, registered under Sections 363, 341, 323, 427, 385 and 387 of the Indian Penal Code.

The accusation is that on 22.10.2018, while son of the informant was present in his potato shop, in the meantime, Abhishek Singh along with others broke the boundary of the shop by Xylo vehicle. When son of informant made protest then all persons went near Dr. S. Pandey standing 4-5 motorcycle there. On the next morning, when son of the informant along with his other relative went to open the shop then Dr. S. Pandey, Vidya Pandey, Ashnarain Paswan, Sochan

No.41240 of 2019(2) dt.04-07-2019 2/2 Paswan reached at the shop and prohibit to open the shop and began to demand Rs. 50,000/- as compensation for breaking the glass of the vehicle. Thereafter, they kidnapped the son of informant by the vehicle of Abhishek Singh and Abhishek Singh asked the informant to come with Rs. 50,0000/- at brick kiln otherwise his son will be killed.

Learned counsel for the petitioners submits that the statement of Daya Shankar Singh, son of the informant, was recorded under Section 164 of the Cr.P.C. in which he has not disclosed the name of the petitioners in the incident of his kidnapping.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Mejorganj P.S. Case No. 423 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
