JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 406,409, 420, 34 of the Indian Penal Code.

The allegation against the petitioner is that he misappropriated government fund, which was allotted for providing scholarship to SC/ST,E.B.C. and O.B.C. students. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. Due to mistake of fact, the present case has been instituted against the petitioner. The alleged amount of Rs. 3, 46,200/- has already been deposited by the petitioner before the competent authority, vide Annexure 3 to the present application.

Patna High Court Cr.Misc. No.50142 of 2016 (2) dt.22-11-2016 2/2 On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in Kursakanta P.S.Case No. 154 of 2016,subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U T
