The petitioner seeks bail in connection with Katoriya (Suiya) P.S. Case no. 270 of 2016 registered for the offence punishable under Section 395 of the Indian Penal Code. 18-19 unknown miscreants are said to have assaulted Munsi of construction company and extended threatening of dire consequences in case of entering into contact with anyone on phone. They also snatched mobile, purse and Aadhar Card of the informant and his companions. It is submitted by the learned counsel for the petitioner that the petitioner is not named in the FIR. Patna High Court Cr.Misc. No.53653 of 2017 (2) dt.09-11-2017 2/2 omnibus. No incriminating article has been recovered from his conscious physical possession. Petitioner has no criminal antecedent. There is nothing in the record indicating complicity of the petitioner in the occurrence barring confessional statement of accused Ghanshyam Yadav and Prakash Yadav and the said accused persons have been enlarged on bail by a co-ordinate Bench of this Court vide order dated 27.03.2017 passed in Cr. Misc. no. 54266 of 2016. The petitioner has been languishing in custody since 17.05.2017.
Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Banka in connection with Katoriya (Suiya) P.S. Case no. 270 of 2016.
