====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 19-11-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bairiya P.S. Case No. 258 of 2018 instituted for the offence under Sections 341, 342, 323, 504 read with Section 34 of the Indian Penal Code, Sections 8, 12 of Protection of Children from Sexual Offences (POCSO) Act, Sections 3 and 4 of Immoral Trafficking (Prevention) Act.

In the written report it is alleged that informant got information that few girls have been placed in Orchestra and were being harassed. The informant informed the local police station. Five girls were recovered from Balua Rampurwa and Pakhanaha with the help of police. It is further alleged that out

Patna High Court Cr.Misc. No.59864 of 2018(3) dt.19-11-2018 2/2 of five girls two namely, Mamta Pawar and Pou Das have been recovered from possession of the petitioner.

Case diary has been received.

The statement of Mamta Pawar and Pou Das is available in paragraphs-7 and 8 of the case diary wherein they have stated that they were participating in Orchestra out of their own free will and after giving performance they both used to return after taking money. They have not levelled any allegation against the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st -cumSpecial Judge, Bettiah, in connection with Bairiya P.S.
