The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, on information having been received about fight between two groups, a raid was conducted and some accused persons including the petitioner herein were caught. It is stated that two live cartridges were recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 4.5.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for more than 8 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Ghoswari P.S. Case no. 57 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Barh, District Patna.
