The petitioner apprehends his arrest in Ghanshyampur P.S. Case No. 194/2015, registered for the offences punishable under Section 376 and other sections of the Indian Penal Code. The petitioner is alleged to have established physical relation with the prosecutrix when the prosecutrix became pregnant the petitioner refused to marry with her. Learned counsel for the petitioner submits that the prosecutrix filed a petition that she was earlier married and she got a child from her husband, but it appears that the prosecutrix is a minor girl and petitioner established physical relation with her.
Patna High Court Cr.Misc. No.39718 of 2016 (3) dt.15-11-2016 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
