====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-12-2021 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Chanpatia P.S. Case No. 261 of 2019 registered under Sections 420 and 409/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that the petitioners are beneficiaries under Swachh Bharat Mission, and they have got the work of construction of toilets and on the basis of reports submitted by Tahsildar/Tax Daroga, Nagar Panchayat, Chanpatia, the informant himself, vide Letter No. 1205 dated

Patna High Court CR. MISC. No.4411 of 2021(2) dt.06-12-2021 2/2 25.09.2019 and Letter No. 1240 dated 03.10.2019, issued regarding completion of construction of toilets in favour of the petitioners as contained in Annexure- 2 and 2/1 of the bail petition. Petitioners have no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the A.C.J.M., West Champaran at Bettiah in connection with Chanpatia P.S. Case No. 261 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
