JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2017 The petitioner seeks regular bail in connection with Sono (Charkpathar) P.S. Case No. 119 of 2017, registered for offences punishable under Sections 147, 148, 149, 120(B), 121(A) of Indian Penal Code and Section 3/4 of the Explosive Substance Act and Section 16, 17, 18, 19, 20, 21 and 22 U.A.P. Act. Police on information that some naxalites have assembled raided the place and from the possession of petitioner one bag containing bomb was recovered.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case only on the basis of suspicion and in fact nothing has been recovered from the possession of the petitioner. Further he has no criminal antecedent and has been in custody for last five months. Heard learned APP also.

Patna High Court Cr.Misc. No.51016 of 2017 (2) dt.21-11-2017 2/2 Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the trial court is directed to expedite the trial and try to conclude it within a period of nine months and if the trial is not concluded within the aforesaid period, petitioner will be at liberty to renew his prayer for bail in the court below itself, who will consider the prayer of the petitioner on the basis of materials available on record at that time.
